Almonte v. Chase: Judgments sold to Debt One for 1.02% of balance
I just posted the Chase / DebtOne agreement and my analysis:

What a wonderful lawsuit. According to Linda Almonte, Chase fired her after she refused to participate in illegal activities, such as “defrauding the federal government regarding the purported value of the portfolio on its books, by defrauding its auditors and accountants regarding the nature and value of the asset, and by ultimately defrauding investors – purchasers of its publicly traded stock.”
That’s straight from Alimonte’s response to the Chase motion to dismiss.
Chase had the case removed to federal court, no doubt because they own many (but not all) federal judges.

NCLC FDCPA and FCRA pleadings and resources on the web
I just ordered the 2010 FDCPA update at the National Consumer Law Center for only $56. If you haven’t previously purchased the manuals and you’re suing creditors or collectors, it’s WELL worth the $150 for the FDCPA manual and the $150 for the FCRA manual.

It shows the price as only $240, but I don’t know if that’s discounted due to my membership. That’s the complete library of ALL subjects and includes many sample pleadings. If you are going to represent yourself in court, that’s a MUST have.

Mortgage rate bait and switch - Quicken Loans refusal to provide rate with 730 FICO score
I just posted at CreditFactors the entire “chat” at the Quicken Loans website.
As long time readers know, Quicken is a vile outfit and you may remember Matthias, the Metavante (Quicken contractor) worker who was fired because he refused to be silent about the massive billing fraud committed by Quicken when it charged customers’ credit cards despite cancellations of the bill pay service.
Once a fraudster, always a fraudster.
Stay away from QUICKEN!
As a Quicken user since the 80s, I finally stopped upgrading their software as required to continue using the online service. Instead of using Quicken to get my bank account info, I just use the free online banking and bill pay.
I couldn’t get their attention regarding the billing fraud, apparently they’re too big to care, but at least they no longer get my financial support. The old Quicken software will keep track of my balances and prepare various reports for many years.

Kim Letus, owner Rondout Legal (process servers) threatens with attorneys
There’s the next genius who thinks that EVERYBODY is afraid of lawyers.
This is regarding the Cohen & Slamowitz debt collection lawsuit and the debtor’s affidavit stating that the papers were NOT posted at his door on 10/3/09 as process server Mark McCumber stated in his affidavit of services.
The debtor found the papers at his door a full week later and he also got a sworn affidavit from a neighbor who confirmed his address with “a” process server AFTER 10/3/09.
We even have a reason for the falsification: the time to serve allowed by the court rules was about to expire.
Cohen & Slamowitz are infamous for their unfair collection practices and I already posted the landmark ruling against them.
One can conclude that they have “relationships” with servers who work extremely cheap because they get lots of business from them and since MOST debt collection suits result in DEFAULTS, there is very little risk of getting caught when falsifying affidavits of service.
NY AG Cuomo had over 100,000 judgments vacated last year because servers routinely falsified affidavits of service.
Nothing changed since. Recently a debt collection suit by Forster & Garbus was dismissed because the affidavit of service claimed personal service. Another lie, and this time it was easy to prove because they indicated the incorrect hair color and height for the defendant on the affidavit.
And now Kim Letus is threatening me with attorneys for publishing the TRUTH.
She posted several times at the Liars & Cheats EXPOSED Cohen & Slamowitz blog and now Ms. Letus is featured in her own topic:
