Health One - National Way:  After over 5 months still no answers to discovery requests

My e-mail to Health One attorney Ken Moyer with Wachtel, Biehn & Malm:

Dear Mr. Moyer:

I only received the 8/5/05 and 8/8/05 Health One responses to my requests for admissions and production, posted at CreditCourt.

The predominant response in the requests for production is “will supplement.”

You can’t accuse me of being a pestering impatient person, those promises were made on 8/8/05, over 4 months ago.

Could you please be so kind and let me know when you think you’ll provide me with those promised supplements?

Did the Health One responses to my 6/24/05 interrogatories get lost in the mail?

They were served in the same mailing as my requests for admissions and production and therefore must have been received by you.  Do I have to file a motion to compel?

It’s beyond belief what these criminals get away with.  Of course any AZ lawyer with half a brain wouldn’t have a problem putting them in their place and racking up a $50K legal bill real fast.

It sucks to be pro se.

Unfortunately, Health One was dismissed a couple weeks ago for lack of personal jurisdiction and failure to state a claim for which relief can be granted because they denied everything and the court ignored my affidavit, recorded call and I got nothing in discovery from Health One.

I filed a motion to compel discovery responses 2 days prior to the hearing, but the court ignored it.

I've been so busy, haven't had time to deal with this. But since Health One is no longer, I might just refile against National Way. Now that I learned a bit about discovery and court procedures, I think I'd do better in a new highly publicized suit.

Wish I wasn't so busy.
