Moving the websites - please resend any e-mail not responded to within 24 hrs

Apparently Stephen Snyder had his attorney Dale Mohlenhoff threaten with legal action for using the trademark “credit after bankruptcy.”

I just received the 5/17/05 letter last week.

It is truly amazing what a small world it is, just a few weeks ago someone sent me his correspondence with Snyder for posting.  I haven’t had time yet, but Snyder obviously wants some attention and I’ll try to post that in credit repair at Fight Back!!! - Snyder fits right in with Lexington and the rest of the credit repair scum.

So, to avoid the problems MasterCard caused my webhost, I decided to move the rest of the domains to http://www.eurovps.com/.

I’m certainly not going to change my publications for idiots like Stephen Snyder and his attorney Dale Mohlenhoff.

Ninth Circuit: Non-commercial “Gripe Site” Does Not Violate U.S. Trademark Law

From Elizabeth L. Fletcher’s Summary:

“… Earlier this month, the U.S. Court of Appeals for the Ninth Circuit (controlling for Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon, and Washington) ruled for defendant Kremer. The court agreed with Kremer’s contentions that the Lanham Act did not apply because Kremer’s site was not a commercial endeavor. “We hold today that the noncommercial use of a trademark as the domain name of a website—the subject of which is consumer commentary about the products and services represented by the mark—does not constitute infringement under the Lanham Act” (Bosley Medical Institute v. Kremer). ...

That’s good news!

I’ve previously posted about Thomas Pollack’s http://www.crownpontiacnissan.com/ site, he prevailed in court and received damages for the temporary shutdown due to the Crown Pontiac injunction.

Don’t know how I missed his webgripesites.com with news about “sucks” sites and many resources.  I’ll be doing lots of reading there.

MasterCard got CreditForum.org shut down—how expensive is “free” speech?

They didn’t even have to threaten with legal action or anything. 

http://www.layeredtech.com/ sent out the 12 hour notice at 5 AM with the shutoff by 5 PM—Central Time.

They never once responded to me, I gave them another day to do so and in the meantime http://creditforum.org/ is offline, of course with a notice explaining why.

I’m not hosting with Layered Tech directly, thank God!  Fortunately, my host manages my server for me and that way I can sleep tonight - knowing that Bailey will deal with similar problems (she can just take one domain or page offline) and I won’t wake up to NO websites.

I was so happy that the new server for the forums was running so good, I finally have a regular backup and since I use the forums a lot myself, I appreciate the fast searches and page loads.

I’m very glad I took the time a few days ago to start the Free Speech forum at Fight Back— I knew better than to think that all my problems were solved.

It is sure strange that M/C waited until AFTER I moved a few weeks ago.  I guess they know that they don’t have a legal right to demand anything and if whoever they send their spam type e-mail to doesn’t shut off a site, there’s nothing they can do.

I’m very tempted to try EuroVPS—just to see how powerful M/C is in Europe.

While I’ve had a number of people offer hosting back in February, I believe they’d all face the same problem - M/C goes directly to their upstream provider.

My interest at this point is not so much to find hosting, but to find out how exactly this web hosting business works.

Obviously, big sites like ripoffreport.com (ROR) or WHT don’t have a problem getting shut down or having to delete postings.  I’ve heard that ROR pays over $6,000/month for hosting and if that’s true, we can take that as a maximum cost for free speech.  I assume that they just signed an indemnity agreement and they can host whatever they want.

Of course that’s more than most people can afford. 

I’m also very interested in any court cases.  I’ll be posting what I can find at Fight Back.

WebHostingTalk deleted my request for hosts who require a court order for civil disputes

This is just absolutely amazing, WHT DELETED my request for hosts who’ll wait for a court order in civil disputes. 

“Requesting hosting is not appropriate in any Forum Category.”

Well, I thought that was the main focus of WHT.  I’m obviously missing something.  Oh, I think I get it.  You are supposed to click on their ADS!
